1. Skill-Based Competition

SweatStakes is a skill-based fitness challenge platform. Success is determined by:

• Personal physical performance and effort
• Achievement of predetermined fitness goals
• Verifiable activity data from connected devices
• Consistent participation throughout the challenge period

Outcomes are not based on chance or luck. All results are verified through objective data from approved fitness tracking devices and services.

2. Eligibility Requirements

Basic Requirements:

• Must be 18 years or older
• Must provide accurate birth date during registration
• Must reside in a jurisdiction where skill-based competitions are legal
• Must be physically capable of participating in fitness activities
• Must have a valid payment method for stakes
• One account per person - multiple accounts are prohibited

By creating an account, you confirm that you meet these requirements and acknowledge that providing false information is grounds for immediate account termination and forfeiture of any winnings.

3. Account Verification

We employ a tiered verification system:

• Basic Account: Age verification through birth date and user confirmation
• Small Stakes/Winnings: No additional verification required
• Withdrawals over $600: Government ID verification required for tax reporting (Form 1099)

SweatStakes reserves the right to:

• Request additional verification at any time
• Hold winnings pending successful verification
• Refuse service to anyone who cannot provide requested verification
• Use third-party services to verify user information

4. Challenge Verification

All challenge activities are verified through:

• Integration with approved fitness tracking devices and apps
• Regular data synchronization throughout the challenge
• Anti-tampering measures to prevent data manipulation
• Manual review of suspicious activity patterns
• Required device connection maintenance throughout the challenge

5. Payment Terms

Stakes and Payouts:

• All stakes are held in escrow until challenge completion
• Minimum stake: $5, Maximum stake: $500 per challenge
• Platform fee: 5% of stakes (non-refundable)
• Failed challenge stakes are donated according to platform rules
• Payouts processed within 7 business days of challenge completion
• Additional verification required for payouts exceeding $600 (tax compliance)
• Winnings may be withheld pending successful verification

6. Charitable Donations

• All charitable donations are final and non-refundable
• Tax receipts are provided by the receiving charity, not SweatStakes
• We make no representations about the tax-deductible status of donations
• Charities are verified through Stripe but we are not responsible for their activities
• 85% of failed challenge stakes go to the selected charity
• 15% retained for platform fees

7. Prohibited Activities

• Data manipulation or falsification
• Use of automated systems or bots
• Gaming or exploitation of platform mechanics
• Collusion between participants
• Creating multiple accounts
• Harassment or unsportsmanlike conduct
• Fraudulent payment activities

8. Account Termination

We reserve the right to terminate accounts for:

• Violation of terms
• Fraudulent activity
• Chargebacks or payment disputes
• Platform manipulation
• Repeated failed verification attempts
• Violation of community guidelines

9. Dispute Resolution

All disputes will be resolved through the following process:

• Initial review by SweatStakes support team
• Appeal process for disputed decisions
• Final binding arbitration if necessary
• Class action waiver applies

10. Limitation of Liability

We are not liable for:

• Charity misuse of funds
• Failed fitness tracking integrations
• Challenge disputes between users
• Technical issues with payment processing
• Personal injury or health issues
• Lost or delayed data from third-party devices
• Force majeure events affecting challenge completion

11. Changes to Terms

We reserve the right to modify these terms at any time. Users will be notified of significant changes. Continued use of the platform constitutes acceptance of modified terms.
